Direct Dealing over Holiday Pay

It has recently come to light that one of the training programs determined that they could engage in "Direct Dealing" over Holiday Pay.  Direct Dealing occurs when an employer and represented employee (all House Officers) discuss and take action without the union’s knowledge or presence, in matters that fall within the scope of the mandatory subjects of bargaining.

This program told residents they could not submit for Holiday pay even though House Officers worked Christmas Eve, Christmas Day, New Year's Eve or New Year's Day.  This was communicated as being somehow endorsed by the HOA and part of the contract.  Programs cannot trade a day off in lieu of a House Officer forgoing Holiday Pay.

To be clear, the HOA does not condone or turn a blind eye to this practice.
